Terms of service

The terms for businesses that use Backly, and for anyone using this website.

Last updated: November 3, 2026

  1. 1. Who these terms are between

These terms are between Backly, a service of Sorkin Capital LLC ("we", "us"), and the business that signs up ("you"). By creating an account or paying, you agree to them.

  2. 2. The service

Backly gives you loyalty cards that your customers save to their phone wallet, a web version of each card, an owner dashboard, and tools for your staff to add stamps and rewards by scanning a customer's card.

Staff need a phone or tablet with a camera at your counter. Backly is not for unattended businesses, like automatic car washes, and does not connect to cash registers at launch.

  3. 3. Plans, billing and cancelling

The price is $99 a month for your first location and $65 a month for each extra location. You can instead pay $990 a year up front. Hands-on setup help is optional, for a one-time $149. We do not offer a trial period.

You pay first. Your card and join page go live after your first payment is received. Billing runs through Stripe.

Plans are month to month. You can cancel anytime from your dashboard. After you cancel, your customers' cards stay readable for 30 days but cannot collect new stamps.

Monthly plan: you can cancel anytime. Cancelling stops future charges. Payments already made are not refunded, except where the law requires it.

Annual plan: if you cancel within 30 days of purchase, you get a full refund. After 30 days, annual payments are not refunded.

  4. 4. The business's responsibilities to its customers

You show your customers your own loyalty-program terms and privacy notice when they join. You send marketing email only to customers who ticked the separate box agreeing to it. You do not offer rewards in return for reviews, because Google does not allow it.

You keep your login and PIN private, and you do not use Backly for tobacco or vape, weapons, adult content, gambling, MLM, financial services, or health clinics.

  5. 5. Apple Wallet and Google Wallet

Your cards depend on Apple's and Google's wallet services. Apple and Google decide when and how updates appear on a customer's lock screen, and they set limits we must follow. While Apple Wallet is not yet available, iPhone customers use the web version of their card.

  6. 6. Who owns the data

Your customer list belongs to you. We handle it on your behalf to run your cards, we keep it separate from every other business's list, and we do not sell it or share it for advertising. You can export your customer list from your dashboard.

We keep our own records of account activity, payments and security events.

  7. 7. Acceptable use

Do not use Backly to break the law, to send spam, to collect information from customers they did not agree to share, to attack or probe our systems, or to copy or resell the service. We may pause an account that does.

  8. 8. Limits of liability

Backly is provided as is. We work hard to keep it running, but we cannot promise it will never be interrupted or error-free. To the extent the law allows, we are not responsible for lost profits or indirect losses, and our total responsibility to you is limited to the fees you paid us in the 12 months before the problem.

  9. 9. Changes to these terms

If we change these terms, we will post the new version here and update the date at the top. If the change is significant, we will email the business owner before it takes effect.

  10. 10. Governing law and contact

These terms are governed by the laws of Maryland.
